DRIVING WITHOUT A SEATBELT

Section 106(1) of the Highway Traffic Act, RSO 1990, c H.8.

Ticket Shield is able to defend you against Driving Without A Seat Belt charges anywhere in Ontario.  Driving with an inoperative seat belt or being charged as a passenger for not wearing a seat belt does not carry any demerit points. Any seat belt-related offences besides these, do carry 2 demerit points.

Seat belt infractions include driver not ensuring that passengers under the age of 16 are wearing their seat belt, not occupying position with a seat belt, not ensuring a child passenger is properly secured, driving a vehicle with the seat belt removed or inoperative, the driver or passenger of a motor vehicle not wearing, or not properly wearing their seat belt.

There are a few exceptions to this law, including driving a motor vehicle in reverse, medical reasons (documentation required), or being engaged in work that requires you to exit from your vehicle at a frequent interval as long as the vehicle does not travel above 40 km per hour.

Penalty:

  • Set Fine: $200.00 – $1000.00
  • Demerit Points: 0-2
  • Additional Penalties: A conviction on your driving record for 3 years

Should I Fight the Driving Without A Seat Belt Charge?

Most definitely.  Driving Without A Seatbelt can be a 2 demerit point offence. Not only can this affect your insurance premiums, if you accumulate enough demerit points, you could face suspension or lose your license completely.
